Terms & Conditions – Club Energy Fitness LTD

1. Membership

1.1. Your membership will begin on the day you join.

1.2. When paying by Direct Debit, an initial payment (Pro Rata) will be required to cover the period up to your first DD payment.

1.3. Your membership is personal to you. You cannot transfer it to another person.

1.4. If Club Energy or the bank/building society makes a mistake with your direct debit payment, you are guaranteed a full and immediate refund from your bank/building society.

2. Fees

2.1. You must pay a monthly membership which will be determined by your chosen membership package.

2.2. Monthly instalments will be due on either the 1st or 15th of each calendar month or the next available working day by Direct Debit.

2.3. We may change the amount of your monthly payments. If we do, we will write to you at the address you have given us 14 days before the changes take place.

2.4. Monthly fees are payable even if you do not use the centre.

3. Cancelling Your Membership

3.1. Memberships cannot be cancelled prior to the agreed contract length that you have signed up for and the last payment has been made. A contract may be cancelled once the final payment has been made; this requires 7 days’ notice We require this notice in writing, and it can be emailed to info@club-energy-otley.co.uk. You will receive a confirmation email once this has been received and processed.

3.2. Any requests to cancel or modify a membership not notified in writing will not be actioned. Our team are instructed to inform our members to send all membership cancellation and membership changes to info@club-energy-otley.co.uk

3.3. We are not able to refund any membership payments for members who have forgot to cancel, or were unaware they are still members. Our members financial failings (not checking bank statements or being aware of gym payments) are not our responsibility.  

4. Centre Rules.

4.1. You must comply with the centre rules/etiquette which forms part of this agreement.

4.2. We may change the rules/etiquette at any time. We will post notice of any changes at the centre.

5. Changing the Agreement.

5.1. We can change the agreement at any time. We will give you 14 days’ notice of this change in writing at the address you have given us.

6. Facilities

6.1. You are entitled to use the facilities available for your category of membership package.

6.2. You may have to pay additional charges to use certain other facilities/activities at Club Energy. You can get a list of these from our reception points. We can change these prices at any time.

6.3. Before using any exercise equipment, you must read and sign the Health Commitment Statement/Pre-Activity Questionnaire and have a supervised induction session. We can refuse access to the clubs’ facilities if we consider your health maybe adversely affected using such facilities. In such circumstances you will be referred to our GP referral team.

6.4. Club Energy may open/close earlier during public holiday periods. Facilities may also close for occasional special events. Notices will be displayed in the centre in advance notifying customers of any changes. No refunds will be available for these periods.

6.5. We may change the centres opening times or withdraw any of the facilities at any time if we need them for events, tournaments, exhibitions, or other special activities.

6.6. We may need to close a facility or part of it for repair/refurbishment on the grounds of health and safety or improving customer service. Fitness classes may also have to be cancelled due to unforeseen instructor unavailability. In the above circumstances we will use our best endeavours to:

6.6.1. Give as much notice as is reasonably practicable by displaying notices in the centre.

6.6.2. Arrange for alternative facilities during a period of closure.

6.7. Your membership does not give you priority over other users or guarantee the availability of facilities.

6.8. Club Energy management reserve the right to change the activity programme. Prior notice will be given in the centre relating to activity cancellations or the introduction of new sessions.

6.9. Promotions do not apply to existing members.

7. Members Access.

7.1 You must scan your membership card/QR access code using the scanner outside the gym entrance door when accessing facilities.

7.2. All members must have their photograph taken for identification purposes; this will be stored on Club Energy's database. This information will solely be used by Club Energy and will not be released to any third parties.

7.3. If you lose your membership card, we will charge £2 to replace it.

8. Junior Members and Children.

8.1. If you are 14-16 (inclusive) your parent or guardian must sign this agreement on your behalf. By signing this agreement your parent or guardian agrees to be always responsible for your behaviour and actions and to pay us any amounts that are due on your behalf.

8.2. When you reach 16 your junior membership will end, and you will automatically and immediately become either a full adult member, or a student member (depending on circumstances)

8.3 Any under 16s who try and gain access during unmanned hours or lie about their age to use the club during unmanned hours, will be banned with no refund.

9. 24-hour access/unmanned gym access

9.1 You must be 16 or over to use the Club during unmanned hours - manned hours are 8am to 8pm weekdays & 9am to 2pm weekends. These hours may change for Bank Holidays & over holiday periods.

9.2 You must complete our health & safety questionnaire and a gym induction (if wanted or needed) before using the gym.

9.3 You cannot permit access to others - your membership only allows access for yourself. Do not let friends in (tailgating)

9.4 The gym & other users must be respected - we will have a strict zero tolerance policy with those that do not abide by this, and memberships will be revoked.

9.5 Tailgating will result in immediate termination of membership with no refund.

9.6 Fire exits are alarmed. Opening said fire escapes during any time other than an emergency will result in immediate termination of membership with no refund.

10. Car Park

10.1 Our car park is for staff of the businesses in our service yard only. There is no facility for members parking on site.

10.2 Any persistent member parking in our service yard will result in membership termination with no refund.  

11. Personal Property

11.1. All personal belongings are the responsibility of the owner. Club Energy will not be heled responsible for the loss, theft or damage of any personal belongings our members bring to the club. 

11.2. Lockers are available at a cost of 20p per use. 

11.3. Bags, shoes and clothing must be kept in the changing rooms or lockers. For health and safety reasons, bags, shoes and clothing can not be left on the gym floor. 

12. Personal Hygiene

12.1. Good personal hygiene is a requirement of membership. Maintain clean and smell free gym attire. Wipe down your equipment after use, using the sanitation stations supplied through the club. 

12.2. Think of other members and leave the equipment how you would expect to find it yourself. 

13. Gym Etiquette

13.1. Be thouhtful of others. 

13.2. Tidy your weights and equipment away. Strip plates from the plate loaded equipment. Leave the training equipment and training areas in a way you would wish to find it yourself. 

12.3. Due to health and safety, no bags are permitted on the gym floor. 

14. Changing Rooms. 

14.1 Be respectful of the changing rooms, please clean any mess you may make. 

14.2 On occassion, due to health and safety, clenliness, and maintenance access to the changing area may be needed by staff members of the opposite sex. We will knock and shout loudly to alert those using the changing area of our intention to enter.
